Introduction

By using Student Pilot Portal ("Service"), which includes all products offered by Student Pilot Portal (www.studentpilotportal.com) and all of it's subdomains, you (collectively referred to as "you", "your", or the "User") agree to be bound by the following terms and conditions ("Terms of Use"), including any subsequent changes or modifications to the Terms of Use. If you do no agree to the Terms of Use, please do not continue to use the Service.

1. Privacy and Communications

Student Pilot Portal may occasionally send you important communications regarding your account or the Service via email. You have control over which emails you receive such as marketing email, promotional email, notification email, and alert email. However, you may not opt out of account email, which includes important information regarding the security or state of your account. More information about email you receive can be found by reading the Privacy Policy.

2. Accounts, Passwords, and Security

You must be a registered user to access the Service. You are responsible for keeping your password secure. You will be solely responsible and liable for any activity that occurs under your user account.

3. Acceptable Use and Conduct

You are solely responsible for your conduct and your data related to the Service. You agree to indemnify, defend, and hold harmless Student Pilot Portal from any and all loss (which includes, but not limited to personal injury or death, costs associated with flying, liability, airport expenses, computer repairs and expenses arising from or related to the Service or data you provide), your use of the Service, or your violation of these terms. The Service is made available to you, your company, and/or your customers only for personal or commercial use, which use must be in compliance with all applicable laws, rules and regulations and must not infringe or violate third party rights.

Any unauthorized use of any Student Pilot Portal Service is a violation of this Agreement and certain federal and state laws. Such violations may subject the unauthorized user and his or her agents to civil and criminal penalties.

4. Appropriate Practices

Student Pilot Portal reserves the right to terminate any account that it finds in violation of its Terms of Use, without refund or advanced notice. Appeals may be made by contacting a Student Pilot Portal Team Member at support@studentpilotportal.com  and are handled on an individual basis.

5. No Warranties or Representations

You understand and agree that the Service is provided "as is" and Student Pilot Portal, its affiliates, and associates expressly disclaim all warranties of any kind, beyond the Refund, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose, non-infringement or bailment of your data on Student Pilot Portal's servers. This also includes the information we provide for courses and other content, as we do not make any guarantees to the accuracy of this information - although every effort is made to keep our information up-to-date, based on the lastest Federal Aviation Regulations - we still make no gaurantees.

Student Pilot Portal, its affiliates, and associates make no warranty or representation, other than the Refund, regarding the results that may be obtained from the use of the Service, the security of the Service, or that the Service will meet any user's requirements beyond the Refund. Use of the Service is at your sole risk. You will be solely responsible for any damage to you resulting from the use of the Service. The entire risk arising out of use, security or performance of the Service remains with you, the user. Without limiting the foregoing, the Service is not designed or licensed for use in hazardous environments requiring fail-safe controls, including without limitation operation of nuclear facilities, aircraft navigation, communication systems, air traffic control, and life support or weapons systems.

6. Limitation of Liability

In no event shall Student Pilot Portal be liable for any indirect, special, incidental, consequential or punitive damages (including but not limited to loss of use, loss of profits, loss of data, loss of property, or loss of life) whether in an action in contract, tort (including but not limited to negligence), equity or otherwise, arising out of or in any way connected with the use of or inability to use this site or the materials therein or resulting from unauthorized access to or alteration of data.

7. Termination of Service

We reserve the right to terminate your account at any time. You also have the option of canceling your account at any time without penalty. In the event of account cancellation you will lose all data related to your account. This information is not retrievable.

8. Conditions

We may modify or terminate our services at anytime, for any reason, and without notice. We reserve the right to modify these Terms of Service at any time without notice. Please review these Terms of Service on occasion as they may change in the future. We may, but have no obligation to, remove accounts and content containing what we determine as unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable material. We will remove content that violates any party's intellectual property or these Terms of Service. An account terminated by Student Pilot Portal will not be backed-up for any reason and will be immediately deleted from our servers.

9. Intellectual Property

Student Pilot Portal claims no intellectual property rights over the material you provide to the Service (such as, but not limited to photos, videos, courses, suggestions, and documents). By publishing or submitting any data to the Service, you give us the right to re-use that content for commercial use such as, but not limited to, marketing materials, lessons, and courses. However, you acknowledge that Student Pilot Portal owns all right, title and interest in and to the Service, including without limitation all intellectual property rights, and such rights are protected by U.S. and international intellectual property laws. You agree that you will not copy, reproduce, alter, modify, or create derivative works from the Service unless that part of the service explicitly indicates that you have permission (for example an open source license) to do so.

10. Use of Remarketing in Online Advertising

Student Pilot Portal may use cookies to store user browsing data, use of cookies may also be used by third party vendors (ie: Facebook, Google, YouTube, Yahoo) to display Student Pilot Portal advertisements (ads) on their platform.

These third party vendors use cookies to serve ads based on a person's browsing activity. We do not have direct control over when a person sees an ad on a third party vendor's site.

Users can control their ad preferences by contacting the respective third party vendor.
